Waterpod LTD Prize Draw Terms and Conditions 2025

By entering the prize draw you are agreeing to these prize draw terms and conditions.

The prize draw is being run by Waterpod LTD, Blewgarth, The Warren, Reading, RG4 7TH, United Kingdom. Registered Company Number: 14558362 (the “Promoter”).

1. Eligibility to enter:

a. The prize draw is open to entrants over 18 years of age.

b. In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win.

c. A maximum of one entry per individual is permitted.

d. The prize draw is free to enter.

2. Promotion period:

a. The survey and prize draw will include those who registered at Waterpod.co.uk/win and visited the Waterpod stand at the Jersey Boat Show 2025 and completed the Waterpod LTD questionnaire before 9 May 2025. Entries after that date will not be included in the draw.

3. How to enter:

a. To enter the prize draw simply complete the survey and provide a name and email address. Participants will only qualify for the prize draw once the survey has been completed.

b. Waterpod LTD will not accept responsibility if contact details provided are incomplete or inaccurate.

4. The prize:

a. The prize will be a 2 night stay aboard a Waterpod floating craft at The Shells in Jersey or another location as may be reasonably determined by Waterpod.

b. The winner will be contacted after the close of the competition and will be invited to select from a range of available dates for their stay.

c. The prize has a maximum value of £400. The winner may choose to stay for a longer duration or during peak dates (where the cost of a two night stay may exceed £400) provided that they agree to pay the difference between the prize value and the total cost of the stay.

d. The craft, location and number of people staying aboard will be discussed and verified once a winner has been drawn.

e. The prize is non-exchangeable, non-transferable and no cash alternatives will be offered.

f. We reserve the right to substitute prizes with another prize of equal or higher value if circumstances beyond our control make it necessary to do so.

G. The Promoter reserves the right to cancel, amend, or withdraw the prize draw at any time without prior notice for any reason. In such event, no liability shall attach to the Promoter.

h. The decision of Waterpod LTD regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.

i. When the prize has been claimed, the winner will have until the end of the calendar year, 2025, to claim the prize.

5. Winner announcement:

a. The winner will be randomly selected from all valid entries received during the Promotion Period by Waterpod Ltd.

b. The winner will be contacted within seven days of the draw via email, using the contact details provided with their entry and will be asked to provide their home address so that their prize can be administered.

c. Waterpod LTD will attempt to contact the winner by email up to two times.

d. If the winner declines the prize or does not respond to the emails notifying them of their win within 14 days of the second email, they will lose their right to the prize, and Waterpod LTD reserves the right to redraw from the remaining valid entries to select a new winner. Winners may be required to submit valid identification before receiving their prize.

6. Receipt of the prize:

a. Please allow 14 days to receive details of the prize by email or telephone call from the Promoter.

7. Data protection and publicity:

a. You consent to any personal information you provide in entering the prize draw being used by Waterpod LTD for the purposes of administering the prize draw, and for those purposes as defined within our privacy notice.

b. Subject to the winner’s rights under applicable data protection legislation, the Promoter shall be entitled to use and feature the name of the winner for publicity purposes and the winner agrees that they will participate in any reasonable publicity arranged by the Promoter or its agencies.

c. The winner agrees to the release of their first name, and city of residence to any other prize draw participants if requested via Waterpod LTD. All entrants may apply for details of the winning participant by contacting us using this form: to the Promoter within 10 weeks of the end of the Promotion Period, as required by the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the “Code”). The Promoter may also be asked to provide the same details to the Advertising Standards Authority (“ASA”) who publish and enforce the Code. This use of winners’ data is necessary for the Promoter’s legitimate interests in complying with the Code. Winners who do not wish the Promoter to disclose these details to members of the public who request them, should let the Promoter know as soon as possible by emailing: info@Waterpod.co.uk Winners may also object to the disclosure to the ASA by emailing the same address, giving reasons. The Promoter will take these reasons into account if the ASA asks for the winner’s details. Please note, however, that the Promoter may nevertheless still be required to disclose this information to the ASA. This may happen where, for example, the Promoter is required to demonstrate that a valid award took place.

8. Limitation of Liability:

a. Nothing in these terms excludes the Promoter’s liability for death or personal injury caused by its negligence or for fraud, or any other liability that the Promoter may not exclude by law. Subject to that, the Promoter and its associated companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits) expense or damage which is suffered or sustained in connection with this promotion or accepting or using any prize, including any loss incurred as a result of any delay and/or failure to perform any obligation to the winner or other entrants that is caused by:

i.technical problems of any kind which may limit or prevent any person’s participation in the promotion;

ii. any loss or damage arising from or in connection with the allocation or enjoyment of a prize;

iii. any act or omission of any third party, particularly any third party involved in the provision of services relevant to the prize; or

iv. any other events beyond the Promoter’s control that may cause the promotion to be disrupted or corrupted or may lead to loss of, or damage to, the winner or to the prize.

b. If any of these terms and conditions are found by a court or regulator to be invalid or unenforceable the remaining other provisions shall continue to apply.

9. General:

a. These terms and conditions shall be governed by and construed in accordance with the laws of England and the parties agree that any dispute or action arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
